How California Overtime Works (CA Labor Code § 510)
California has the most comprehensive daily overtime laws in the United States. Unlike federal law, California calculates overtime on both a daily and weekly basis.
Daily Time-and-a-Half Tier
Any work performed beyond 8 hours up to and including 12 hours in any single workday must be compensated at no less than 1.5× the employee’s regular rate of pay.
- Applies to all non-exempt employees regardless of whether weekly hours exceed 40.
- Also applies to the first 8 hours worked on the 7th consecutive day of work in a single workweek.
Daily Double-Time Tier
Any work performed beyond 12 hours in any single workday must be compensated at no less than 2.0× the employee’s regular rate of pay (double time).
- Mandatory for all hours exceeding 12 hours on any regular workday.
- Applies to all hours worked beyond 8 hours on the 7th consecutive day of work in a single workweek.
7th Consecutive Workday Rule
Under California Labor Code § 510, when an employee works 7 consecutive days in a single defined workweek, special enhanced pay rates apply on day 7.
- First 8 hours on Day 7: Paid at 1.5× regular hourly rate.
- All hours beyond 8 on Day 7: Paid at 2.0× double-time rate.
Alternative Workweek Schedules (AWS)
Under an approved AWS agreement (e.g. 4 days of 10 hours), employees may work up to 10 hours per day without daily overtime if approved by a 2/3 secret ballot vote of affected employees.
- Hours past 10 up to 12 in an AWS day are paid at 1.5×.
- Hours past 12 in any workday remain strictly 2.0× double time.
