The 7-Consecutive-Day Workweek Rule
Under FLSA 29 U.S.C. § 207, overtime must be calculated on a strict 7-consecutive-day (168-hour) workweek basis. Each workweek stands alone.
- Week 1 and Week 2 cannot be averaged together.
- Overtime earned in Week 1 must be paid on that bi-weekly check even if you work fewer hours in Week 2.
Example of the Illegal Averaging Trap
Suppose you work 50 hours in Week 1 and 30 hours in Week 2. Total hours worked across the bi-weekly period = 80 hours.
- Illegal Averaging: Employer pays 80 regular hours with $0 overtime.

The Hospital & Care Facility 8/80 Exception
The only federal exception to the 7-day rule is for hospitals and residential healthcare institutions under FLSA Section 7(j) with prior written agreement.
